Terms of Service

1. Scope

These Terms apply to all services provided by Evooke Studio / Maximillian Rybka in the fields of web design, videography, social media management, and automation. Deviating agreements are only valid if confirmed in writing.

2. Services

The offered services include:

• Web Design & Development

• Videography & Content Creation

• Social Media Management

• Automation & Chatbot Solutions

3. Prices & Payment Terms

• Invoices are due within 14 calendar days after issuance, unless otherwise agreed.

• For web design projects: 50 % upfront, 50 % upon completion. For large projects (€10,000+): 40 % at project start, 40 % after design approval, 20 % upon go-live.

• For Social Media “Pulse” packages: monthly billing in arrears.

• For Social Media “Spotlight” projects: 50 % upfront, 50 % upon completion.

• Additional costs (e.g., ad budgets, third-party services) will be invoiced separately.

• In case of late payment, statutory late fees and interest apply.

4. Revisions

• 1–2 feedback rounds are included.

• Additional revisions will be billed separately (at least 10 % of the project fee or as agreed).

• Minor edits of up to 30 minutes per month are included depending on the package.

5. Client Obligations

• The client agrees to provide required materials, feedback, and information within 48 hours.

• Delays caused by the client automatically extend the project timeline.

6. Usage Rights & References

• Usage rights are transferred only after full payment has been made.

• RAW files and open project files will not be provided unless explicitly agreed.

• The provider may showcase the created works as references in portfolio, website, and social media.

7. Project Termination

• If the client terminates the project, all services rendered up to that point plus a minimum of 50 % of the total project fee are payable.

• If the provider terminates, only the work performed will be charged, and any overpayment will be refunded.

8. Liability

• The provider is liable only for intent and gross negligence, except in cases of injury to life, body, or health.

• No liability for failures of third-party providers (hosting, social media platforms, tools).

• Liability for data loss applies only in cases of gross negligence by the provider.

9. Legality of Content

• The provider ensures that used media are free from third-party rights.

• The client is responsible for content supplied by them (e.g., logos, texts, photos).

10. Data Protection

The Privacy Policy applies as published on www.evooke.de.

11. Governing Law & Jurisdiction

German law applies. Place of jurisdiction is Bottrop, Germany.
